HAMILTON COUNTY DISTRICT COURT
Before Judges Ranney, Oliver, Murdock and Headingron: State of Ohio Ex. Rel. Silas V. and Moses Hayes vs The Cincinnati & Indiana Railroad Company. - An alternative writ of mandamus was heretofore allowed in the case, and it now came up for hearing on an application to make the order peremptory, compelling the Railroad Company to pay into the Probate Court the sum of $33000, being the amount of a verdict which the paintiffs recovered as the compensation for land in Whitewater wornship, approprated for railroad purposes.
It was claimed, on behalf of the defense, that the railroad company had the right to abandon the proceeding after the verdict, and change their route. Also, that the plaintiffs should have brought their action within thirty days after the rendition of the verdict, and that mandamus was not the remedy to apply in this case.
Argued by Judge Collins, for the paintiffs, and by D. T. Wright and A. Bower for defense.

His wife, 33 year old Rachel, keeps house and was born in Indiana. Their children, all born in Ohio, are: 9 year old daughter, Sallie, at home, attends school; 7 year old son, Moses, at home, attends school; 2 year old son, Frank, at home. Also living with the family are 4 nephews, [children of Moses Hayes and Mary Jane Guard]: 19 year old nephew, Ezra, at home, attends school; 17 year old nephew, Charles, at home, attends school; 15 year old nephew, Enoch, at home, attends school; 13 year old nephew, Isaac, at home, attends school; 11 year old daughter, Anna, at home, attends school.

Silas Hayes is a 47 year old white male farmer, married to 42 year old Rachel Hayes. Silas was born in Ohio, his father in Pennsylvania, his mother in Kentucky. Rachel was born in Indiana, as were her parents. Living with them are seven of their children, all born in Ohio: 21 year old daughter, Anna; 18 year old daughter, Sarah; 16 year old son, Moses, at home, attends school 8 of 12 months; 13 year old son, Frank, at home, attends school 8 of 12 months; 9 year old son (per census), Holly, at home, attends school 8 of 12 months; 4 year old daughter, Bessie (census report checked off "married"); and 2 year old son, Silas.
Also living with Silas is his 88 year old widowed mother, Sarah, born in Kentucky, her parents in Pennsylvania.
There are two boarders, and two servants. The boarders: 63 year old widow Mrs Fitzharris, from England; 36 year old farm laborer Wm. Doherty, from Ohio. The servants: 23 year old Anna Rupson of Indiana; 19 year old Barbara Smith, also of Indiana.

Education - two years at Farmers' College at College Hill, Ohio, but was called home when his father's health failed, and was never permitted to return. In August,1857, he married Rachel P. Miller, daughter of Enoch and Elizabeth Hayes Miller, and to this union were born five sons and five daughters. My. Hayes was a publicly spirited man, ever ready to support church and school interests. He had an extensive acquitance and was respected by all. (Source - The Hayes Family Page 234)

Silas Van Hayes, was born May 31, 1833, and is the son of Enoch and Sarah E. His mother was Stephens, married in April, 1813. His father came from Chester county, Pennsylvania, in 1806, and died October 23, 1857, in Dearborn county, Indiana, being born December 27, 1791. Silas Van is one of a family of five sons and three daughters, the youngest, Silas, the only one living. His father is of Scotch-Irish descent. His mother's father was of Irish origin, and his grandmother came from New Jersey. In education he devoted himself for two terms in earnest effort at Farmer's college, and would have continued longer, but his father's health failing, he was called home and never permitted to return. In August, 1857, he married Rachel P. Miller, daughter of Enoch H., of Dearborn county, Indiana, who bore him five sons and five daughters--three sons and two daughters being dead. Politically, S. V. Hayes is one of note. For five years he has been a member of the board of control and in minor offices has been prominent. Mr. Hayes is one of the coming men of this county.
